Vehicles are shipped by Canadian Railway companies as well as independent Auto Carriers. Insurance is provided by these companies when they are involved in the shipping process.
All vehicles are only insured while on the railcars, or in an auto carrier. It will be up to the owner to insure them while they are on the ground waiting to be shipped, or when they arrive. The insurance does not cover any personal belongings left in the vehicle. Travel times given are based on average travel times from previous shipments. Weather conditions, track blockages, and track repairs can cause delays. Once a delay has happened, our agents can only give an estimated time of arrival, and estimates could change depending on the conditions.
Upon receiving your vehicle, you must sign a release form before you leave the yard. If there is any damage to your vehicle it must be noted at this time. It is agreed that once your vehicle leaves the yard, no further claims can be made.
Our insurance shall not be liable for damages to one individual vehicle which exceeds the lesser of a.) Actual vehicle repairs b.) The depreciated average wholesale value of the vehicles as based on the "Canadian Red Book" value of the vehicle at time and place of shipping.
The insurance does not cover rental vehicles, and all claims are subject to a $500. deductible. For vehicles 20 years old or older, it will be the owner’s responsibility to insure them. Our insurance will not cover these types of vehicles.
Conditions not covered by the insurance are, environmental pollution, bird droppings, acid rain, diesel exhaust, soot, mechanical defects, broken or lose parts caused by train vibration, any of the exhaust systems, and radio antennas. All vehicles must have a six inch road clearance. Any vehicles being shipped under six inch road clearance will be shipped at the owners risk and liability and will not be covered by our insurance. Trucks with large mirrors must be removed before shipment. Glass or Windshields having rock chips, scratches or gouges are not insured. (Train vibration can make these defects crack the glass), and our insurance will not cover this.
We will no be liable for roof racks, off road flood lights; etc. Items must be removed before delivery to the compound.
Limitations of Liability: J. Simons or its agents will not be liable for any indirect or consequential damages, including with our limitations, loss of revenue or profits which are based upon, aroused out of or connected with the contract or anything done or maintained hereunder of anything not done or maintained as required hereunder, even if such damages were foreseeable.
Force Majure: A party to this contract shall be excused from its contractual obligations if it is prevented or delayed in such performance by any events which are unavoidable or beyond its reasonable control including acts of God. Acts of the Queens enemies, floods, rockslides, snow slides, washouts, avalanches, storms, earthquakes, expropriation, fire or explosion, strikes, lockouts, walkouts, or any other industrial disputes, war, sabotage, riot, insurrection, derailment, labor shortages, power or fuel shortages, the act of failure to act of any government or regulatory body.
All Vehicles are subject to random searches by police. J. Simons or its agents are not responsible for any vehicle’s condition after being searched.
